  • legitimate interests in promoting current and future ART of programmes, subject to applicable legal requirements and the rights of the individuals concerned

  • consent where consent is legally required

  • protection of the vital interests of a participant in an emergency

Different legal grounds may apply to different processing activities.

Acceptance of the ART of Terms & Conditions forms part of the contractual framework governing participation and includes the programme media provisions described in those Terms.

ART of does not use a separate optional Yes/No Promotional Media Consent as a general condition within the Dresden application process.

Where applicable law nevertheless requires a specific separate consent for a particular type of processing or use, ART of will obtain that consent where required.

Where consent is the relevant legal basis, it may be withdrawn for future processing. Withdrawal does not affect processing that occurred lawfully before the withdrawal or processing supported by another applicable legal basis.

8. Applicants and participants under 18

Where an applicant is under 18, ART of collects parent or guardian information and the required authorisations.

Parents or legal guardians should ensure that the information submitted for a minor is accurate and that they are authorised to provide it.

The parent or legal guardian is responsible for accepting the ART of Terms & Conditions on behalf of the minor where required.

This includes the programme participation conditions and the photography, filming and media provisions contained in the Terms & Conditions, subject to applicable mandatory law.

ART of may contact the parent or guardian to verify participation arrangements, authorisations, safeguarding information or other matters relevant to the minor’s application and attendance.

Where mandatory law requires an additional or separate authorisation or consent, ART of may request it.

9. Application decisions

Admission and scholarship decisions are made through individual human assessment.

ART of does not use solely automated decision-making or automated profiling to determine admission or scholarship awards.

Submitting an application does not create a right to admission or financial support.

10. Application-file security

Uploaded application files are stored outside the publicly accessible website directory.

Security measures include:

  • encrypted HTTPS transmission

  • server-side file-type and file-size validation

  • randomly generated stored filenames

  • restricted administrative access

  • password-protected application administration

  • CSRF protection

  • rate limiting

  • Cloudflare Turnstile bot protection

  • separation of public website files and private application storage

Application files are not intentionally published and should not be included as ordinary email attachments.

Authorised ART of personnel access the files only where required for application review, administration, safeguarding or legal purposes.

No internet transmission or storage system can guarantee absolute security. ART of nevertheless applies reasonable technical and organisational measures appropriate to the nature of the information processed.

11. Email notifications and communication

After an application is submitted, ART of may receive an administrative email containing the application reference and relevant application information.

Uploaded application files should be accessed through the protected server workflow rather than being attached to ordinary notification emails.

Email transmission is normally protected in transit where supported by the participating email providers. Standard email is not necessarily end-to-end encrypted.

12. Hosting and email services

The website, application system and associated email services are hosted by:

Variomedia AG
August-Bebel-Strasse 68
14482 Potsdam
Germany

Variomedia may process technical, hosting, email, backup and server information on behalf of ART of to provide and protect the website and its associated services.

Further information is available at:
https://www.variomedia.de/datenschutz/

13. Cloudflare Turnstile

The application form uses Cloudflare Turnstile to distinguish legitimate human submissions from automated abuse.

Turnstile may process technical information concerning the browser, device, network connection and interaction with the security check. This information is processed for website security and abuse prevention.

Cloudflare may process information outside Switzerland or the European Economic Area under the safeguards described in its applicable privacy documentation.

Further information is available at:
https://www.cloudflare.com/privacypolicy/

14. PayPal payments

Application fees and other authorised payments may be processed by PayPal.

Payment credentials, card details and PayPal passwords are entered directly into PayPal’s systems. ART of does not receive or store those credentials.

ART of may receive:

  • payer name and email address

  • payment reference

  • amount and currency

  • transaction identifier

  • payment status

  • invoice or application reference

PayPal processes personal data independently under its own terms and privacy statement.

Further information is available at:
https://www.paypal.com/privacy

15. Photographs, videos and media use

Photographs, audition videos and other artistic material submitted by an applicant as part of an application are primarily used for application assessment, artistic evaluation, group placement, scholarship assessment where applicable and programme administration.

Submission of such application material does not by itself authorise ART of to publish that pre-existing material for advertising or commercial promotion.

Separate rules apply to photographs, video recordings, audio recordings and other audiovisual material created by ART of or persons authorised by ART of during ART of programme activities.

During the ART of Ballet Winter Intensive Dresden, ART of and persons authorised by ART of may photograph, film, audio-record or otherwise document programme activities.

These may include:

  • ballet classes

  • pointe and technique work

  • variations

  • repertoire sessions

  • rehearsals

  • coaching

  • choreographic or creative workshops

  • body-awareness or related programme sessions

  • presentations

  • organised photography or filming sessions

  • registration activities

  • other programme-related activities

By submitting the application and accepting the ART of Terms & Conditions, the participant and, where the participant is under 18, the parent or legal guardian accept the programme media provisions contained in those Terms & Conditions.

Subject to applicable law, resulting photographs, video recordings, audio recordings and excerpts may be processed and used by ART of for purposes including:

  • internal documentation and archive

  • ART of websites and programme websites

  • Instagram, Facebook, TikTok, YouTube and other social-media platforms

  • organic social-media communication

  • paid social-media and digital advertising

  • brochures, flyers, posters, banners and printed programme material

  • newsletters

  • press and public-relations communication

  • presentations

  • promotional films and trailers

  • advertising and marketing campaigns

  • commercial promotion of ART of programmes and activities

  • promotion of current and future ART of programmes, projects and editions

  • communication with ART of venues, partners and collaborators where connected with ART of communication or promotion

Subject to applicable law and the applicable Terms & Conditions, ART of may crop, resize or technically adapt photographs, edit video or audio, create excerpts or compilations and combine material with text, graphics, design, ART of branding, logos or music for the permitted purposes.

The programme media provisions are not limited solely to the Dresden edition during which the material was created and may apply to communication concerning future ART of programmes and editions as described in the Terms & Conditions.

No additional remuneration is normally payable for uses covered by the accepted Terms & Conditions unless expressly agreed otherwise in writing.

There is no separate optional Yes/No Promotional Media Consent in the general Dresden application process. Acceptance of the Terms & Conditions forms part of the contractual framework governing programme participation and the media provisions described above.

This does not override mandatory data-protection, personality, image, child-protection or other rights that cannot legally be waived.

Where applicable law requires a specific additional consent or another particular legal basis for a certain processing activity or media use, ART of will apply the corresponding requirement.

Where a person has a statutory right to object to processing or withdraw a consent that constitutes the relevant legal basis, the request applies to future processing in accordance with applicable law.

A withdrawal or objection does not affect processing or publication that occurred lawfully before it became effective and does not automatically require the recall, destruction or reprinting of material already lawfully produced or published where applicable law does not require such action.

Privacy and media-related requests may be sent to:

contact@art-of.net

Where required, ART of relies on an adequacy decision, recognised contractual safeguards, standard contractual clauses, explicit consent or another legally permitted mechanism.

The destination countries and applicable safeguards may depend on the service provider used at the time of processing.

18. Retention

Personal data is retained only for as long as it is reasonably required for the purpose for which it was collected or for an applicable legal, contractual, safeguarding, evidential or documentation requirement.

As a general policy:

  • incomplete and unsuccessful applications are deleted or anonymised within 12 months after the end of the relevant course edition

  • admission photographs, audition material and other artistic application files of accepted participants are normally deleted within 12 months after the course unless another lawful purpose requires retention

The website may link to or contain content from external services such as PayPal, YouTube, Vimeo, social networks, programme partners or accommodation providers.

When an external link is opened or external content is activated, the relevant provider may process personal data under its own privacy policy.

ART of may retain limited information where processing is required by law or remains necessary for accounting, contractual obligations, safeguarding, outstanding payments, dispute resolution or the establishment, exercise or defence of legal claims.

Where possible, information that is no longer required will be deleted or anonymised.
